  • Yes – any work that is done requires a permit. With HVAC, the common misconception is that if the outdoor unit is under 3 tons, you do not need a permit. This is incorrect.

    Under 3 tons – You need at minimum a General Construction (GC) permit.

    3 tons and over – You will need a mechanical permit, so the DOB issues you a certificate of compliance for the outdoor unit. This document prevents the FDNY from issuing a violation if they visit and find the unit was installed without a permit.

  • According to the law – yes, you do. But that has not stopped many people from doing the work without permits.

    Safety and quality of work are the more obvious reasons to get permits – the work is subject to third-party inspection, which discourages contractors from cutting corners.

    Where New Yorkers really feel the pain is when they are slapped with a violation by the DOB. Besides paying a fine on top of getting permits to legalize the work, depending on what you have done, you may be fined daily until the issue is corrected (or you undo all the work you have done).

    So in short, everything is great—until you get caught.

  • Duration varies based on the scope, existing conditions, construction, etc. There is no one-size-fits-all answer, but it is always worth having a conversation to discuss and set expectations.
